LEGALITIES
Foreigners may purchase land and
property in Turkey in their own
names provided that properties
are located in towns (i.e. there
must be municipality in the area
where the property is located
and the property must be
situated within the boundaries
of that municipality or
borough), not in village or
rural areas and outside of
militatary zones.
When buying a property in
Turkey, the legal procedures are
as follows :
Brandrup Estate Agency carry out
the searches on the Title Deed
for you, once a property has
been chosen. And we ensure that
it’s clear of debts and the
seller is the person named on
the Title Deed.
Then a deposit (usually 10%-20%
of the asking price but
sometimes 75 % for the new build
properties) is placed in a bank
account in Turkey and paid to
the seller on your behalf.
Then there is a waiting period
of 3-6 months for the paperwork
to be cleared by the officials
and army departments in
Izmir-Ankara-Mugla. The
remaining balance plus any
additional costs are transferred
to the same bank account and the
Title Deeds can be exchanged as
soon as the Fethiye Title Deeds
office receives the clearance
from the army department
confirming that the property is
not within an military area.
The Title Deeds formalities can
all be carried out in your
absence, by leaving a Power of
Attorney with us the Brandrup
Estate or with your solicitor.
Upon your decision to use our
Estate Agency for the work, will
take you to a Notary to arrange
the Power of Attorney(through a
official translator at the
Notary’ office to ensure you to
understand the text), then open
a bank account in your name with
you and have the necessary
photos required for the paper
work.
Our Agency will be able to
provide surveys upon request of
the customers.
ADDITIONAL COSTS
• Brandrup Estate Agency charge
3% finders fee-over and above
the final agreed price.
• A Buyers Tax which is paid by
the purchaser at the time of
Title Deed transfer which is
calculated on the rateabl value
of the property.
• Annual ground rates are
minimal.
• Cost for electric and water
registration when you purchase a
property.
• DASK (Compulsory Government
Insurance)
• EKP ( Education aid fund)
• Cartography Office fee
• New Government Tax depends on
location (all properties are
subject to revaluation every
year for tax purposes).
